Ashley St. Clair has taken legal action against Elon Musk, seeking sole custody of their baby boy. The 26-year-old author filed the case in New York’s Supreme Court on February 21, asking the court to legally recognize Musk as the child’s father and grant her full legal custody. According to St. Clair, their son, identified as R.S.C., was born in September 2024 and has spent very little time with his alleged father.
In her filing, St. Clair claims Musk wasn’t present for the baby’s birth and has only seen his son three times since then. She also included a request for a formal paternity declaration, even though she states Musk has already acknowledged the child in private conversations.
St. Clair says their relationship started around May 2023, and their son was conceived in January 2024. She provided alleged text messages from Musk after the baby was born, where he expressed excitement about seeing the child, reportedly writing, “I look forward to seeing you and him this weekend.” She also claims Musk once texted, “If I make a mistake on security, [R.S.C.] will never know his father,” which she views as further acknowledgment of paternity.
Despite these messages, St. Clair says Musk has been largely absent. She details that he first met their son on September 21, 2024, spending two hours with him, and saw him for just one hour the following day. The last visit, she claims, happened on November 30, lasting only 30 minutes.
Adding more complexity, St. Clair alleges that even after their son’s birth, Musk sent suggestive messages about having more children together, including one on November 24, 2024, saying, “I want to knock you up again,” and another three months later about having a “legion of kids.”
Her attorney, Karen B. Rosenthal, says they’ve tried to settle this matter privately with Musk’s legal team, but those efforts have been unsuccessful. Rosenthal also noted that because of Musk’s high-profile role in the Trump administration, serving him legal documents at the White House has proven difficult.
This legal battle comes amid more public drama for Musk, as his former partner and mother of three of his children, musician Grimes, recently accused him of ignoring their child’s medical crisis. In a post on social media platform X, Grimes claimed Musk had been unresponsive to her messages and missed important medical meetings, leaving their child’s health in jeopardy.
As this story unfolds, it puts a spotlight on Musk’s complicated personal life and his ongoing struggles with co-parenting and custody. With St. Clair’s legal case now in motion, the world will be watching closely to see how it all plays out.
