The man, whose name hasn’t been disclosed, is married to a U.S. citizen and has two young children born in the United States. Despite having no criminal record and actively working to obtain his green card, he now finds himself entangled in a process that’s as heartbreaking as it is frustrating.

According to the family’s immigration lawyer, Kate Lincoln-Goldfinch, the man is undocumented but is on the path to legal residency. However, due to the way he entered the country, he must navigate the lengthy consular process, which can take anywhere from two to six years.

During the stop, the man’s wife and children were left waiting on the roadside for three hours. To make matters worse, their infant had no food or diapers during that time. The lawyer criticized authorities for detaining the father, calling it an unnecessary disruption to a family trying to do everything by the book.

Lincoln-Goldfinch expressed deep disappointment over the cancellation of a Biden-era program called Keeping Families Together, which aimed to fast-track legal status for over 500,000 undocumented spouses of U.S. citizens. “This policy could’ve protected families like this one,” she said, lamenting the program’s suspension by federal courts.
A Growing Web of Enforcement
Texas law enforcement agencies have a history of working closely with ICE, and experts predict these collaborations will only intensify. Governor Greg Abbott has already committed to ramping up deportation operations and border security measures, which include expanding detention centers and building more sections of the border wall.
Lincoln-Goldfinch warns of an uptick in “collateral arrests,” where undocumented individuals near targeted migrants are detained simply because they’re in the wrong place at the wrong time.

In a single weekend, ICE made nearly 880 arrests, and daily averages for the year hover around 310 arrests per day.
