Senate Democrats Press for More Financial Transparency Ahead of Kennedy Confirmation Vote

With a scheduled committee vote on Tuesday for Robert F. Kennedy Jr.’s confirmation as Secretary of Health and Human Services, Senate Democrats are demanding more transparency regarding his ties to vaccine-related lawsuits. Senators Ron Wyden and Elizabeth Warren have called on Kennedy to commit to recusing himself from any vaccine-related decisions if confirmed.

In a letter released Monday, Wyden and Warren expressed concerns after Kennedy disclosed plans to transfer his financial stake in an ongoing vaccine lawsuit to his son, Connor Kennedy, a California-based attorney at Wisner Baum. The law firm is representing plaintiffs in a lawsuit against Gardasil, an HPV vaccine deemed safe by the Centers for Disease Control and Prevention.

The senators criticized the arrangement, stating that allowing Kennedy’s immediate family to financially benefit from his position as health secretary was “troubling” and “plainly inadequate.” They argued that Kennedy’s financial disclosures were incomplete, failing to specify how many cases he had referred to Wisner Baum and whether they were vaccine-related.

It remains uncertain whether the Democrats’ letter will impact Kennedy’s confirmation, as the Republican-majority Senate could still approve his nomination. However, Republican Senator Bill Cassidy of Louisiana, who chairs the Senate Finance Committee, has raised concerns about Kennedy’s past statements on vaccines. During a recent hearing, Cassidy questioned whether Kennedy’s views had changed and if he would base decisions on unbiased scientific data.

Wisner Baum has stated that Kennedy has not received payments for vaccine-related cases, as the Gardasil lawsuit is still ongoing. However, Wyden and Warren argue that Kennedy’s involvement presents a direct conflict of interest, given that the Health and Human Services Secretary has oversight of vaccine policies.

In their letter, the senators warned that Kennedy could use his authority to influence litigation outcomes, potentially leading to financial gains for himself or his family. The Senate Finance Committee, chaired by Cassidy, is set to vote on Kennedy’s nomination on Tuesday, and it remains to be seen whether opposition from both parties could slow the confirmation process.
